Big Fish Technology — Worry-Free Wi-Fi
Effective Date: 03/22/23 Updated: 06/14/26
Notice and Acceptance
This guest wireless network (“the Network”) is provided and managed by Big Fish Technology (“Big Fish,” “we,” “us,” or “our”) on behalf of the facility where it is offered (“the Host”). It operates under managed access policies similar to public and hospitality environments.
This Network does not use a sign-in screen, captive portal, or click-through acceptance page, and for the foreseeable future no such portal will be used. Access is provided openly. By connecting to or using the Network, you acknowledge that you agree with this Acceptable Use Policy (“Policy”) and you agree to be bound by it. If you do not agree to this Policy, do not connect to or use the Network.
This Policy is made available to users by posting at the published address above and to the Host, rather than through an access page. The current version of this Policy is always available online and supersedes any prior version.
Purpose and Scope
The Network is provided to support general internet access for authorized guests and is designed to offer a reliable, fair, and secure experience for all users. This Policy applies to every person and device that connects to the Network, at every facility where Big Fish provides this service. It serves as the default acceptable use policy for the service across all such locations.
Permitted Use
The Network is intended for standard, lawful internet activities, including:
- Web browsing and online services
- Email and messaging applications
- Streaming audio and video content
- General mobile and cloud-based applications
Users should expect an experience comparable to public or hospitality Wi-Fi.
Your Responsibilities
By using the Network, you agree that you are responsible for your own activity and for the security of your own devices, and that you will use the Network only for lawful purposes and in accordance with this Policy.
Prohibited and Restricted Activities
1. Unlawful Use
You may not use the Network for any unlawful purpose or to facilitate any unlawful activity. Prohibited unlawful uses include, without limitation:
- Infringing copyrights, trademarks, or other intellectual property — including the unauthorized downloading, uploading, or sharing of movies, music, software, games, or other protected works, whether via BitTorrent, other peer-to-peer (P2P) tools, or any other method
- Accessing, storing, transmitting, or distributing illegal content
- Harassment, threats, fraud, or other unlawful conduct directed at any person or organization
- Unauthorized access to, scanning of, or interference with any system, network, or data
You are solely responsible for your activity on the Network and for any consequences arising from it.
2. High-Volume or Disruptive Usage
Activities that generate excessive or disproportionate network traffic may be limited, throttled, or blocked, including:
- Peer-to-peer (P2P) file sharing (e.g., BitTorrent)
- Large or continuous data transfers
- Persistent high-volume background network activity
3. Non-Standard Network Communication
The Network may restrict traffic that relies on:
- Uncommon, dynamic, or non-standard communication ports
- Direct device-to-device connections
- Peer-to-peer protocols used for file sharing, optimization, or tunneling
These restrictions help maintain network stability, performance, and security.
4. Attempts to Circumvent Network Controls
You may not attempt to bypass, defeat, evade, or disguise the Network’s safeguards, monitoring, or filtering. Prohibited attempts include, without limitation:
- Spoofing, randomizing, or altering a device’s MAC address or other identifiers to evade blocking or identification
- Using VPNs, proxies, Tor, or other tunneling methods to bypass filtering, restrictions, or monitoring
- Changing ports, protocols, or DNS settings to avoid network controls
- Otherwise disguising the identity, origin, or nature of your traffic
Such attempts are a serious violation of this Policy and may result in immediate disconnection, device blocking, and reporting. (Note: using privacy tools to protect your own device is your responsibility and not, by itself, prohibited; what is prohibited is using such tools to bypass or evade the Network’s controls.)
5. Security and Abuse
You may not use the Network to attack, probe, overload, or interfere with the Network, the Host’s systems, other users, or any third party; to distribute malware; or to engage in any activity that threatens the security or integrity of the Network or any connected system.
Monitoring and No Expectation of Privacy
The Network is actively managed and monitored, and network traffic may be inspected and logged. By connecting to or using the Network, you consent to such monitoring, inspection, and logging, and you acknowledge that you have no expectation of privacy in your use of the Network. We may use this information to operate and secure the Network, enforce this Policy, manage performance, investigate suspected violations, and respond to lawful requests. This is not a private or secured network and should not be treated as one.
Security Protections
For user safety and network integrity, automated security controls are in place to:
- Detect and block malicious, exploit-related, or abusive traffic
- Prevent abnormal or potentially harmful behavior
- Limit suspicious outbound connections
Network Security and Your Data
This is a shared, open, public-style network. It is not a secure or private connection, and traffic on it may be visible to others. We do not guarantee the confidentiality, security, or integrity of any data you transmit, and you use the Network at your own risk. You are responsible for protecting your own devices and information, including the use of appropriate security measures for any sensitive activity.
Service Provided “As Is”; No Warranty; Limitation of Liability
The Network is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including any warranty of availability, reliability, performance, or fitness for a particular purpose. We do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, Big Fish Technology and the Host, and their respective owners, employees, affiliates, and agents, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including data loss, security incidents, service interruptions, or any harm arising from your use of, or inability to use, the Network — even if advised of the possibility of such damages.
Indemnification
You agree to defend, indemnify, and hold harmless Big Fish Technology and the Host, and their respective owners, employees, affiliates, and agents, from and against any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Network or your violation of this Policy or of any applicable law.
Internet Service and Third-Party Terms
Internet connectivity for the Network is provided over a standard commercial internet service (currently Comcast Xfinity). Your use of the Network is therefore also subject to the internet service provider’s acceptable use and other applicable policies. Complaints regarding network abuse — including copyright (DMCA) notices — may be directed by the provider to the account holder, and unlawful or abusive activity on the Network may be investigated and acted upon accordingly.
Host Facility and Additional Policies
Where the Network is provided at a Host facility, that facility’s rules and any applicable organizational, institutional, or governmental policies also apply and may impose additional or stricter requirements than this Policy. Where a conflict exists between this Policy and a Host or governmental policy, the more restrictive requirement governs.
User Experience Expectations
Under normal, permitted use, users should experience:
- Reliable and stable internet connectivity
- Access to common services and applications
- Consistent performance for everyday tasks
Potential Limitations
To maintain service quality and security for all users, some services may be affected, including:
- Certain VPN or privacy tools
- Online gaming features that rely on peer-to-peer connections
- Non-standard or specialized applications
These limitations are necessary to maintain performance, availability, and security for everyone.
Reservation of Rights
We reserve the right, at any time and without prior notice, to:
- Monitor, inspect, and log Network traffic
- Throttle, prioritize, restrict, or block traffic, ports, protocols, applications, or destinations
- Block, suspend, or terminate the access of any device or user
- Report suspected unlawful activity to, and cooperate with, law enforcement and other authorities
Changes to This Policy
We reserve the right to modify, update, or replace this Policy at any time, at our sole discretion and without prior notice. Any changes are effective when the updated Policy is posted. Your continued use of the Network after changes are posted constitutes acceptance of the revised Policy. The current version is always the one published at the address shown above.
Enforcement
The Network is actively managed to ensure compliance. Violations of this Policy — or use that negatively affects Network performance, security, or other users — may result in reduced connectivity, throttling, device blocking, suspension or termination of access, and, where appropriate, reporting to the Host and to law enforcement. We may take any of these actions at any time, with or without notice.
Reporting and Contact
To report a problem, abuse, or a security concern related to the Network, contact the Host.
